1. Overview

Welcome to Folkmake. The terms “we”, “us” and “our” refer to Folkmake. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”), powered by Shopify.

These Terms of Service (the “Terms”), together with any policies referenced here, describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using the Services, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Returns and Exchanges Policy. If you do not agree, do not use the Services.

2. Access and Account

• You represent that you are at least the age of majority where you reside.
• You may be asked to provide information such as your email address and billing, payment, and shipping details. You represent and warrant that all information you provide is current, accurate, and complete, and that you have the right to provide it.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You may not transfer, sell, assign, or license your account.

3. Our Products

• Many products offered by Folkmake are one-of-a-kind, small-batch, handmade, made-to-order, or custom pieces. Subtle variations in color, texture, finish, shape, or minor asymmetry are inherent to handcraft and are not defects.
• We try to describe and display products as accurately as possible, but appearance on your screen may vary based on device and settings. We do not warrant that any product will appear exactly as depicted on your device.
• Product descriptions, pricing, and availability may change at any time without notice. We may discontinue any product or limit quantities to any person, geographic region, or jurisdiction.

4. Orders

• By placing an order, you make an offer to purchase. We may accept or decline any order at our discretion. We must receive and process payment before acceptance. If we decline or change an order, we will attempt to notify you using the contact details you provided.
• Your purchases are subject to our Shipping Policy and Returns and Exchanges Policy.
• You represent that your purchases are for personal or household use and not for commercial resale or export.

5. Prices and Billing

• Prices, discounts, and promotions may change without notice. The price in effect at the time of order applies and will be set out in your order confirmation email.
• Where shown at checkout and supported for your order, duties and taxes may be included in the price you pay. Otherwise, taxes, customs duties, import fees, or similar charges may apply in accordance with our Shipping Policy.
• Prices in our online store may differ from prices elsewhere. Promotions may be subject to separate terms; if those conflict with these Terms, the promotion terms govern.
• You agree to provide current, complete, and accurate purchase, payment, and account information and to promptly update it so we can complete transactions and contact you as needed.
• You represent and warrant that you are authorized to use the payment method provided and that charges will be honored.

6. Shipping and Delivery

• Folkmake offers free worldwide shipping on orders where such shipping is offered on the store.
• Production time varies by product. The most accurate production timeline for each item is shown on its product detail page.
• We dispatch orders promptly after production is completed and the item passes final quality inspection.
• After dispatch, standard international delivery typically takes around 7–15 days, depending on destination, carrier operations, customs processing, and local delivery conditions.
• Delivery windows shown on product pages or elsewhere on the Services are estimates only. Carriers, customs, weather, seasonal capacity, and other factors may affect timing.
• For some products and destinations, paid express shipping may be available at checkout. Express shipping shortens transit time after dispatch, but does not shorten production time.
• To avoid delaying ready items, we may ship an order in multiple parcels when needed. If this happens, you will receive tracking information for each parcel.
• You are responsible for providing a complete and deliverable shipping address. If a parcel is returned due to an incomplete or undeliverable address, refusal, or repeated failed delivery attempts, additional shipping charges may apply for re-shipment.

7. Returns, Refunds, and Exchanges

Your purchase is subject to our Returns and Exchanges Policy. A summary is provided below for convenience only. If there is any conflict, the Returns and Exchanges Policy controls.

• Non-custom, non-made-to-order products: change-of-mind returns are accepted within 14 days after delivery only if the item is unopened, unused, and returned with the original packaging fully intact. The customer is responsible for return shipping costs.
• Custom or made-to-order products: returns or exchanges are not accepted for non-quality reasons.
• Quality-related issues: if an item arrives damaged, the wrong item was shipped, or the item is materially not as described, you may request a return, exchange, replacement, or refund review in accordance with our Returns and Exchanges Policy. If the claim is approved, Folkmake will cover the relevant return shipping cost and, where applicable, reshipping cost.
• Unboxing video: for claims involving damage on arrival, wrong item shipped, or materially not as described, an unboxing video is required as key evidence under our Returns and Exchanges Policy.
• Do not return any item without first contacting us and receiving return instructions.

8. Intellectual Property

The Services and their entire contents and functionality, including text, graphics, logos, images, video, audio, design, selection, and arrangement, are owned by Folkmake, its affiliates, or licensors and are protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only. Except as permitted by law or with our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any materials from the Services.

Folkmake names, logos, product and service names, designs, and slogans are trademarks of Folkmake or its licensors. Shopify’s names and marks are trademarks of Shopify. All other trademarks belong to their respective owners.

9. Optional Tools

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. We have no control over these tools and no liability arising from your use of them. Use is at your own risk and subject to the providers’ terms.

10. Third-Party Links

The Services may link to or embed third-party sites, content, or functionality. We are not responsible for examining or evaluating third-party materials and are not liable for any harm related to your access to or use of them. Review third-party terms and policies before engaging in any transaction with them.

11. Relationship with Shopify

Folkmake is powered by Shopify, which enables us to provide the Services. Sales and purchases are between you and Folkmake. Shopify is not responsible for any aspect of sales between you and Folkmake, and you release Shopify and its affiliates from claims arising from such transactions.

12. Privacy

Personal information we collect through the Services is subject to our Privacy Policy, and certain information may also be processed by Shopify under its own privacy policy. By using the Services, you acknowledge these policies.

13. Feedback

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant Folkmake a worldwide, non-exclusive, sublicensable, royalty-free, perpetual license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose.

You represent that you have the necessary rights to grant this license and that your Feedback complies with these Terms.

14. Errors, Inaccuracies, and Omissions

Information on the Services may contain typographical errors or inaccuracies, including about product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct errors and update information at any time, including after you place an order.

15. Prohibited Uses

You may use the Services only for lawful purposes. You may not, directly or indirectly:

• violate any applicable law or regulation
• infringe intellectual property, privacy, or other rights
• harass, abuse, defame, threaten, or harm others
• transmit malware, spam, or deceptive content
• attempt to impersonate another person or entity
• scrape or collect personal information without consent
• interfere with or circumvent security features of the Services
• otherwise engage in conduct that, in our judgment, harms Folkmake, Shopify, or other users

We may suspend or terminate access for violations.

16. Events Beyond Our Control

We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, shortages, pandemics, war, terrorism, governmental actions, utility or communications outages, or carrier and logistics disruptions.

17. Disclaimer of Warranties

The Services and all products are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

18. Limitation of Liability

To the fullest extent permitted by law, Folkmake and our directors, officers, employees, affiliates, agents, contractors, service providers, and licensors, and Shopify and its affiliates, will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages; or for lost profits, revenue, savings, data, or replacement costs; arising out of or related to your use of the Services or any products.

Our total liability for direct damages shall not exceed the amount you paid for the product or service giving rise to the claim.

19. Indemnification

You agree to indemnify, defend, and hold harmless Folkmake, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, and expenses, including reasonable attorneys’ fees, arising out of your breach of these Terms, violation of law, infringement of rights, or misuse of the Services.

20. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

21. Waiver and Entire Agreement

Our failure to enforce any right or provision is not a waiver. These Terms, together with policies referenced herein, are the entire agreement between you and Folkmake regarding the Services and supersede prior or contemporaneous agreements and communications.

22. Assignment

You may not assign or transfer these Terms or any rights or obligations without our prior written consent. We may assign or transfer these Terms without notice.

23. Governing Law and Venue

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflicts of law.

You and Folkmake consent to the exclusive jurisdiction and venue of the state and federal courts located in Oregon for any dispute arising out of or relating to the Services or these Terms.

24. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when changes were made. We will post updates on this page and, where required, provide additional notice.

Your continued use of the Services after changes are posted constitutes acceptance of those changes.
